§ 1  Primary Sources

§ 1.1 U.S. Constitution and Earlier Documents
The National Archives Experience "Charters of Freedom" covers the Constitution, Declaration of Independence and Bill of Rights in depth with the histories of ratification, profiles of influential founders and detailed images of original documents.  The Federalist Papers are on Yale Law School's Avalon Project, also a source of significant numbers of U.S. treaties.

§ 1.2 U.S. Code and Statutes
The Office of the Law Revision Counsel of the U.S. House of Representatives publishes the official U.S. Code as well as the code online.  Their search features are more robust than many subscription services offer.  You can choose to download entire sections of the current code or past codes back to 1988. Cornell's Legal Information Institute uses the Law Revision Counsel's database and incorporates updates to any section.  This is not a codification, but an update which is included on the same page as the original section.

Public Laws going back to the 104th Congress (beginning at 1995) are searchable at GPO Access.  Little, Brown & Co. were granted congressional authority to publish Statutes at Large from 1789-1875 and are available at the National Archives site.

§ 1.3 C.F.R., Federal Register and Administrative Material
GPO Access is the most complete resource for Federal Register (1994 - current), C.F.R. (1996 - current) and List of Sections Affected (1997 - current).  www.firstgov.com covers GPO Access as well as other public and private sites.  Submission of comments on proposed regulations may now be done online at Regulations.gov.
Congressional Research Service reports are not generally made available to the public. 
The Memory Hole makes many of these available and links to other sites that do the same.

§ 1.4 Executive Orders
GPO Access makes all Executive Orders available from 1993 to present.

§ 1.5 Administrative Law Decisions and Agency Opinions

U.S. Department of Agriculture National Appeals Division has recently made their decisions from 2002 available with an advanced search feature.

The Commodities Futures Trading Commission's opinions and orders are searchable by month and year back to 1997.

The U.S. Consumer Products Safety Commission's Advisory Opinions are searchable by item number or subject.

Davis-Bacon Wage Determinations provides searching decisions by state or by by advanced searches with a combinations of state, keyword and date restrictions.

U.S. Department of Education Office of Hearing Appeals decisions back to 1989 by keyword and year.

Equal Employment Opportunity Complaint Appeals Decisions are available from July 2000 to July 2004 and are keyword searchable.

The Federal Deposit Insurance Corporation Enforcement Decisions and Orders dating back to 1975 are searchable by date, category, action, party name and keyword.

The Federal Elections Commission Advisory Opinions back to 1977 are searchable by AO number, year or keyword.

Federal Labor Relations Authority Decisions, Policy and Guidance has cases back to 1994 and are organized by date/volume number.

Federal Maritime Commission Electronic Reading Room contains decisions back to 1997 organized by date.

The Federal Mine Safety and Health Review Commission decisions back to 1995 searchable by year.

Federal Trade Commission actions go back to June 1996 and are searchable by month and year.

U.S. International Trade Commission makes available "recent petitions and complaints." Currently this list goes back to July 2004.

The Department of Labor Office of Administrative Law Judges coordinates all online decisions and allows for searching the current docket.

U.S. Merit Systems Protection Board Decisions back to 1979-80 searchable by year and keyword.

The National Credit Union Administration has Administrative Orders complete back to 1998 and Legal Opinion Letters back to 1991.  Both are keyword searchable.

National Labor Relations Board decisions are available online from volume 272, Sept. 15 1984 to present and are keyword searchable.

National Transportation Safety Board Opinions and Orders go back to 1992 and are searchable by order number, regulation charged, corporation or individuals named, date, aviation or marine and keyword.

U.S. Occupational Safety and Health Review Commission ALJ Decisions back to 1993 and Final Commission Decisions back to 1978.  Decisions are searchable by year or keyword searchable by using the site search feature on the Commission's home page.

Office of Government Ethics Advisory Opinions back to 1979 are organized by year and keyword searchable through GPO Access.

Office of Personnel Management Compensation Policy Memoranda date back to December 1996.

Pension Benefit Guarantee Corporation Opinion Letters date back to November 1974 and are searchable by opinion letter number, date, range of dates or keywords.

Postal Rate Commissions Opinion and Recommended Decisions are searchable on the site's search page.

U.S. Postal Service Administrative Decisions date back to 1957 and are organized by year and keyword searchable.

The Railroad Retirement Board post a few significant decisions.

The Securities and Exchange Commissions Enforcement Actions include Federal Court Actions back to Sept. 20, 1995,  Administrative Proceedings back to Sept 19, 1995, ALJ Decisions back to Oct 31, 1995 and Commission Opinions back to April 5, 1996.  Keyword searches are possible for the entire site at the top of any SEC site page.

Small Business Administration Office of Hearing Appeals makes available SIZE and NAICS (SIC) code decisions back to about 1990, 8(a) BD decisions since 1992, All SDB decisions and Development Company decisions since 1997.  Searching may be done by keyword, regulatory section number or type of action.

Social Security Administration Social Security Rulings and Acquiescence Rulings date back to 1960 and are organized by a Table of Contents and an index corresponding to the published version plus a year by year and alphabetical part list.

Veterans' Administration Board of Veterans' Appeals has a Decisions Search page with year and keywords searching

§ 1.6 Agency Materials

The First Amendment Center has an excellent guide entitled How to File a FOIA Request.

§ 2  Court Websites
The Federal Judicial Center publications and history and biographies of all judges.  Specific case information for matters in all courts is accessible for a fee from PACER.

§ 2.1 Supreme Court
The Supreme Court's official site contains current information plus opinions back to 2001 and transcripts of arguments back to October 1999.  To find earlier opinions choose from a list of several sites that have undertaken the job of making these cases available for free.  Goldstein & Howe, P.C. host the SCOTUSblog, a very professional and excellent resource for news and information on issues currently before the Court and discussions of the impact of recent decisions.  the American Bar Association's Supreme Court Preview also provides briefs of upcoming cases.

§ 3 Secondary Sources
Both Westlaw and Lexis are investing heavily their databases in the area of federal practice, specifically in access to district court level documents.  Westlaw's product is called WestDocket®.  Lexis has a comparable version called CourtLink®.  While wherelaw.com doesn't endorse these products, if your practice includes significant amounts of federal work, it would be worth looking at services that may include documentation on cases you are involved in, could potentially be involved in, and how these services could identify and alert you to such cases.  This is the fastest growing service area of these two major providers.  These databases also cover state courts in many areas, but have not reached in to any Mid-South jurisdictions yet.

§ 4 Legislation and Legislative History
Thomas is the Library of Congress's legislative resource. Here's a brief list of how far back you can search each resource:  Bill Summaries and Status from 1973 (93d Congress), Public Laws from 1973 (93d), Full Bill text from 1989 (10st), Congressional Record from 1989 (101st) and Committee Reports from 1995 (104th).
